By accessing or using Medianode's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
Medianode LLC ("Medianode," "we," "us," or "our") provides media server infrastructure hosting services. We provide the technical infrastructure to deploy and manage containerized media server applications. We do not provide, host, store, or distribute any media content.
You are solely responsible for providing your own storage and media sources, ensuring you have legal rights to any media on your server, maintaining your own media server accounts, and configuring your own media libraries.
Medianode operates as a neutral infrastructure provider, similar to cloud hosting services such as AWS, DigitalOcean, or Hetzner. We provide computing resources and container orchestration. We do not control, monitor, or have access to the content you place on your allocated server resources.
We do not monitor the content of your media libraries, have access to your media files, index or catalog your content, or know what media you store or stream.
All media storage is provided by you, the customer. You connect your own storage solution to your media server container. Medianode has no access to, control over, or responsibility for this storage or its contents.
You agree to comply with all applicable local, state, national, and international laws; ensure you have legal rights to any media you access through your server; not use the Services for any illegal purpose; and not infringe upon the intellectual property rights of others.
You represent and warrant that you own or have obtained all necessary licenses for any media on your server, your use of the Services does not violate any third-party rights, and you will not use the Services to distribute unauthorized copyrighted material.
You may not use the Services to store, distribute, or stream content you do not have rights to; engage in any activity that violates applicable law; resell or redistribute access without authorization; attempt to gain unauthorized access to our systems; or interfere with the operation of our Services.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use our Services.
Services are provided on a subscription basis. Current pricing is available on our website. All fees are non-refundable except as required by law. Subscriptions renew automatically unless cancelled before the renewal date. Failure to pay may result in suspension or termination of your account.
Medianode complies with the Digital Millennium Copyright Act (DMCA). If you believe content accessible through our Services infringes your copyright, please send a DMCA notice to: dmca@medianode.io
We will terminate accounts of repeat infringers in appropriate circumstances.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDIANODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
YOU ACKNOWLEDGE THAT MEDIANODE HAS NO CONTROL OVER AND NO RESPONSIBILITY FOR THE CONTENT YOU ACCESS OR STORE USING OUR SERVICES. YOU ASSUME ALL RISK AND LIABILITY FOR YOUR USE OF ANY CONTENT.
You agree to indemnify, defend, and hold harmless Medianode, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Services, your violation of these Terms, your violation of any third-party rights, or any content you access, store, or distribute using the Services.
You may cancel your account at any time through your account settings or by contacting support. We may suspend or terminate your account immediately if you violate these Terms, we receive a valid legal order, we believe your use poses a security risk, or your account is used for illegal activity.
These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes individually and waive any right to participate in class action lawsuits.
